1. Who you are interacting with

These terms are between you and KidBits Games LLC, a limited liability company registered in North Carolina, United States, operating playkidbits.com.

By buying a game you agree to these terms. Please read section 5 in particular, which covers what happens after we start building, and section 6, which is the refund policy.

How we handle your information is set out in our Privacy Policy, which forms part of these terms. Two points in it are worth flagging here rather than leaving buried, and both work the same way. Your own email address is used to send you emails about new games and updates, and it may also be used for advertising. Both run on an opt-out basis, meaning we do not ask first. Every marketing email carries an unsubscribe link, one click ends it permanently, and unsubscribing stops the advertising use as well, so you never have to do both. You can also email privacy@playkidbits.com at any time. Neither ever involves any information about a child, and neither has any effect on your order, your delivery or your refund rights. The marketing and advertising section of the Privacy Policy explains both in full.

2. What you are buying

A personalized video game starring a child you describe. You choose a game, then build a cast of up to four characters: a lead plus up to three companions, who can be siblings, parents, grandparents, friends, anyone.

All prices are in US dollars. Nothing is posted to you, so there is no shipping charge. We currently sell only to customers in the United States.

The prices above are our standard prices. From time to time we run a sale, or issue a discount code, and the price you pay is whatever is shown on the checkout button before you pay and on the Stripe payment page itself. Those two always agree, and they are the price. If a sale is running you will see it on the site; you do not need a code to get a sale price. A discount code, where you have one, is entered on the final screen before checkout and the total updates before you pay.

Discount codes are issued by us and remain ours. A code may be limited to particular games, to a number of uses, to a period of time, or to the email address it was issued to. Only one discount applies to an order: if a code and a sale are both available, you get whichever is worth more, and they are not added together. Codes have no cash value, cannot be exchanged for money, and we may withdraw an unused code at any time. Refunding an order does not restore a code that was used on it.

Rush delivery is the one optional extra. At checkout you may add rush delivery for $10.00, which moves your order to the front of the queue and shortens our delivery target from 72 hours to 24. It is entirely optional, the game itself is identical either way, and it is the only charge that can be added to your order. Sales and discount codes apply to the price of the game only and never reduce the rush delivery fee, so if we miss 24 hours we can refund that fee in full, exactly as section 5 describes.

What you receive: a private link to a game that plays in any modern web browser, on a phone, tablet or computer. The game is a single self-contained file. You can save it and keep it, and a saved copy plays offline, permanently, with no account and no subscription.

What it is not: an app from an app store, a physical product, or a subscription. There is nothing to install and nothing recurring.

3. You must be an adult, and you must have the right to describe the child

By ordering you confirm that:

  • You are 18 or older.
  • You are the child's parent or legal guardian, or you have the permission of a parent or guardian to provide the child's first name and appearance for this purpose.
  • The details you give us are ones you are entitled to share.

We sell to adults. Children do not create accounts, do not fill in forms, and cannot buy from us.

4. What you choose, and what we choose

You choose: the game, each character's first name, and their gender, age stage, skin tone, hair style, hair color, eye color and the item they carry, each from a fixed list of options.

A few things are worth knowing before you order. These are not defects and are not grounds for a refund on their own:

  • The option lists are fixed. We offer a set number of choices for each feature. They may not include every combination you would like. What is shown on the order page is what exists.
  • Names are displayed in the game's own style. Kart Racing, for example, shows names in capitals and fits them to the space available. Very long names are sized to fit rather than shown at full size.
  • Games include characters you did not create. Each game has a supporting cast of other racers, other fighters and companions that we provide. If you do not fill all four character slots, we fill the rest.
  • We may decline a name. Our system refuses names containing contact details, web addresses, code, or unambiguous profanity, and a person reviews anything borderline. We would far rather review an unusual real name than reject one, but if we cannot build a game with the name you have given us, we will contact you and refund you in full.

We choose everything else: the artwork, the story, the music, the game mechanics, the dialogue and the supporting cast.

5. How your order is fulfilled, and when you can still stop it

This section matters, so it is plain.

Building starts within about a minute of payment. It is automatic. There is no practical window in which you can cancel before work begins, and we are not going to pretend otherwise by writing a clause that describes one.

The sequence is:

  1. You pay. We email you a confirmation immediately.
  2. We build your game based on your customizations on our backend systems.
  3. We review it before it goes anywhere.
  4. We email you a private link.

We aim to deliver within 72 hours.

Rush delivery

If you added rush delivery at checkout, we aim to deliver within 24 hours. That clock starts the moment your payment succeeds, not at the start of the next business day, and it does not pause overnight or at weekends.

If we miss 24 hours, we refund the $10 rush fee. You do not have to ask. Your game is still built, still reviewed and still delivered. You simply do not pay for the speed you did not get. Everything else about the order is unaffected, and your link keeps working.

Rush delivery is only offered when we are in a position to honor it. If you do not see the option at checkout, we are not able to promise 24 hours at that moment, and we would rather show you nothing than sell you a promise we are going to break.

Rush delivery changes the speed and nothing else. It does not change the game, the review step, or any part of the refund policy below.

If something goes wrong and we cannot deliver at all, we will tell you and refund you in full.

6. Refund policy

The short version: if we have not sent your link yet, you get a full refund for any reason. Once it is delivered, we will fix any problem, and refund you if we cannot.

Before we have sent your link

Full refund, no reason needed. Email support@playkidbits.com. Even though building begins within a minute, nothing has reached you yet, so there is nothing to argue about.

After we have sent your link

Email support@playkidbits.com within 7 days and we will make it right if:

  • The game does not load or does not work in a current browser
  • What we built does not match what you ordered: the wrong name, the wrong appearance choices, the wrong game
  • Something is missing or broken in the game itself

We will normally offer to rebuild it first, because a rebuild is quick for us and usually gives you what you actually wanted. If you would rather have your money back than a corrected game, say so and we will refund you. This only applies if the request has been made during the 7 day window after we have sent your link. We will not make you accept a rebuild.

Typos and changes of mind about the details

Tell us and we will rebuild it for free within the 7 days of us having sent your link. If you misspelled a name or picked the wrong hair color, that is not a refund situation. It is a five-minute fix, and we would rather have a happy customer than a refunded one. There is no charge and no limit on reasonable corrections.

Changing your mind about the purchase itself

Once the game is delivered, you have a file that you can keep permanently and that we cannot take back. A change-of-mind refund after delivery is at our discretion.

We ask that if you receive a refund, you delete any copies of the game you have saved. We cannot enforce that, and we are telling you plainly rather than pretending we can.

What a refund does

Refunds are issued to your original payment method and typically appear within 5–10 business days, depending on your bank.

A refund switches off your private link immediately. The hosted game stops working the moment the refund is processed.

It cannot reach a copy you already saved. If you saved the file to your device before the refund, that copy keeps working. We have no technical way to disable it. This is a consequence of the game being genuinely yours to keep, which is a feature we are not going to remove.

Partial refunds

We do not offer partial refunds, with a single exception: the $10 rush delivery fee. If you paid for 24-hour delivery and we missed it, we refund that $10 on its own and the rest of the order stands. The game is still yours and your link still works. See section 5.

If you used a discount code or bought during a sale, a refund returns what you actually paid, not the standard price. A refunded order does not give the code back: a single-use code that was spent on a refunded order has been used. If that leaves you out of pocket on something that was our fault, email us and we will sort it out.

Apart from that one case, an order is either refunded in full or it is not. A full refund includes the rush fee if you paid one.

Please talk to us before disputing a charge

If something is wrong, email support@playkidbits.com. A chargeback costs us a fee and takes weeks; an email usually gets you a fixed game the same day. We will always try the direct route first, and so should you.

7. What you may do with your game

When you buy a game, we grant you a personal, non-exclusive license to keep and play it, forever, for personal and family use.

You may:

  • Play it as much as you like, on any of your devices
  • Save copies and keep them permanently
  • Share the file or the link with family and friends
  • Give the game to the person you bought it for. Many of these are gifts. If you bought it for a child, a grandchild, a niece or a friend's family, you may hand the link and the file over to them and the license comes with it, and they have the same rights under this section that you did
  • Show it publicly in a personal capacity: a birthday party, a classroom, a video of your kid playing it

You may not:

  • Sell it, rent it, or charge anyone for access to it. Giving it away is fine, selling it is not
  • Redistribute it commercially, or publish it on a site or store as your own
  • Modify the game engine, or extract its artwork, code, music or mechanics for use in another product
  • Attempt to reverse-engineer the engine, or use it to build personalized games for other people

We keep ownership of everything except your child's name. The engine, artwork, music, characters, story and mechanics are ours. What is personalized is the character in it, not the game around it.

Your child's name and appearance choices remain yours. We use them to build your game and for nothing else. We do not sell them, and we never send them to any marketing or advertising platform. This is absolute and is not affected by any advertising choice you or we make about your own email address. How we handle them is set out in our Privacy Policy.

We may show your game as an example only with your permission, asked separately. We will never use a child's name or likeness in marketing without a parent or guardian saying yes first.

8. Technical requirements and limitations

Games require a reasonably current web browser. They are tested on current versions of Chrome, Safari, Firefox and Edge.

We cannot guarantee a game will work on every device, on very old software, or on a device with unusual restrictions. If it will not run for you, tell us. That falls squarely under section 6.

A saved copy plays offline. Because it is a file on your device, keeping it safe is up to you. We keep your game available on our systems for 3 years from delivery and will re-send your link on request during that time.

We may improve or change the games we sell at any time. We will not alter or withdraw a game already delivered to you.

9. Things we have to say, in plain language

We provide the games as they are. We work hard on them and a person checks every one before it goes out, but we cannot promise a game will be free of every bug or will run perfectly on every device that exists.

Our responsibility is limited to what you paid. If something goes wrong and we are at fault, the most we will owe you is the amount you paid for that order. We are not responsible for indirect losses such as a disappointed birthday, lost time, or anything similar.

Nothing here limits any right you have under law that cannot be limited by agreement.

10. Using this website

Beyond buying a game, a few things about the site itself.

You may browse it, build a game, save your progress and come back to it, and use it as any customer would.

You may not:

  • Use automated tools such as bots, scripts or scrapers to browse the site, submit orders, or create draft builds
  • Create draft orders in volume, or submit orders you do not intend to complete
  • Attempt to reach a game link that is not yours, guess or enumerate delivery links, or use a link after it has been switched off
  • Attempt to access our systems, database or stored files by any route other than the one the site provides
  • Interfere with the site's operation, or with anyone else's use of it
  • Copy our engine, artwork, music, text or page designs for use elsewhere

Every draft build you start stores a child's first name and appearance choices on our systems. Creating them in bulk is not a harmless technical exercise. It fills our database with real children's data that we then have to hold and delete. We treat it accordingly.

We may block access, cancel orders or refuse service to anyone doing these things, without notice. Where an order is canceled and it was genuinely yours, you are refunded in full.

11. Suspending or refusing service

We may refuse or cancel an order, with a full refund, if:

  • We cannot build a game with the details provided
  • We believe the order is fraudulent or the payment method is not yours
  • The details submitted are abusive, or appear designed to harm or embarrass a child
  • Someone is attempting to use the service to build games commercially for third parties

12. Sales tax

Prices exclude any applicable sales tax. This applies to the rush delivery fee in the same way it applies to the game.

13. Changes to these terms

We may update these terms. The version that applies to your order is the one published when you bought it. If we make a significant change we will note it here with a new date, and where it affects an existing order we will email you.

18 August 2026. Section 1 now flags that emails about new games and updates also run on an opt-out basis, alongside the advertising use already described there. Giving us your email address enrolls you, and the unsubscribe link in any of those emails ends them permanently in one click. This is not applied backwards. If you gave us your address before this date and did not tick the box that then existed, you were not added and you will not be, even if you buy again. Nothing about pricing, delivery, refunds, what you are buying, or what we collect about a child changed.

12 August 2026. Section 7 no longer calls the license “non-transferable.” That word was doing one useful job, stopping resale, but it also appeared to forbid the most ordinary thing our customers do, which is buy a game as a gift and hand it to the family it was made for. Gifting is now written in explicitly, and the ban on selling, renting or charging for access is unchanged. This is a widening of your rights, so it applies to every order, including ones placed before today.

11 August 2026. Section 2 now covers sales and discount codes: how a discounted price is shown before you pay, that only one discount applies to an order rather than several stacking, and that a sale or code reduces the price of the game and never the rush delivery fee. Section 6 records that a refund does not restore a used code. Standard prices are unchanged, and orders placed before this date were not discounted.

11 August 2026. Section 1 now flags that a customer's own email address may be used for advertising on an opt-out basis, with a link to the full explanation and the opt-out address in the Privacy Policy. Section 7 restates that the promise covering a child's name and appearance choices is absolute and unaffected by that. Nothing about pricing, delivery, refunds or what you are buying changed.

9 August 2026. Added optional rush delivery ($10, 24-hour target) in sections 2 and 5, and a matching exception to the partial refund rule in section 6. Orders placed before this date are unaffected: rush delivery did not exist and no order carried a delivery charge.

14. Governing law and disputes

These terms are governed by the laws of the State of North Carolina, United States. Any dispute will be handled in the state or federal courts located in North Carolina.
